Art.1 Definition buyer and identity of the trader
1. Buyer is a natural or legal person who places an order under the applicability of these terms and conditions of any article, product, as offered on the site of tessakoops.com.

Article 2: Applicability
o All offers, orders and agreements tessakoops.com (hereinafter: Tessa Koops) these General Terms and Conditions (= Conditions). 
o Accepting an offer or placing an order implies that the purchaser accepts the applicability of these Terms.
o From the provisions of these Conditions may only after written notice or approval in writing by Tessa Koops, remain in full force the remaining provisions in any case.
o These conditions respect the rights of the buyer arising from the law (or sales).

Art.3: Offers / agreements
o All offers by Tessa Koops are free and Tessa Koops expressly reserves the right to change prices, especially when under (legal) regulations.
o An agreement is only after acceptance of the order by Tessa Koops. Tessa Koops is entitled to refuse orders or attach certain conditions to the delivery, unless otherwise specified. If an order is not accepted, Tessa Koops communicate this within ten (10) days after receipt of the order.

Art.4: Prices and payments
o The prices for the products and services offered are in Euros, including VAT in the Netherlands, but excluding any taxes or other levies, unless otherwise stated or agreed in writing. The handling- and shipping costs are already calculated according to the place of delivery.
o The buyer pays the full amount, including shipping costs in advance via PayPal, iDEAL or by bank transfer. The payment is made at the time Tessa Koops has listed the total amount to the bank account. The buyer may not assert any rights regarding the implementation of the order or service (s) before the advance payment has been made.
o The buyer has the obligation to report immediately to the trader any inaccuracies in data supplied or specified payment.
o In case of buyer's default, the operator subject to legal restrictions, the right to charge the buyer the reasonable costs charged.

Article 5: Delivery
o Tessa Koops has a maximum delivery time of 3 weeks, unless otherwise agreed with the buyer. If the ordered products are not delivered within three weeks, the buyer has the option to terminate the agreement by means of a written notice which must be received by the Seller.
o The delivery times specified by Tessa Koops are only indicative. Late delivery does not entitle to compensation.
o The risk of damage and / or loss of products until the time of delivery to the buyer at the business, unless otherwise agreed.
o After the day of receipt of the product the buyer within 14 days, the right to terminate the agreement, stating the reasons and to return the product or exchange. Buyer must within 14 days to notify in writing (via e-mail or letter) and the product (in original and complete packaging) undamaged and return UNUSED IN ITS ENTIRETY. In any other state, the product is not returnable! While buyer shall bear the cost and risk of the return. If the buyer has already made some payments, Tessa Koops, after accepting a return, refund the amount.
o The risk of damage and / or loss of returns until the time of delivery to Tessa Koops by the buyer, unless expressly agreed otherwise.

Art.6: Complaints and liability
o Purchaser is obliged to inspect whether the delivery complies with the agreement. If this is not the case, the buyer must Tessa Koops as soon as possible and set in any case within two (2) days after having informed the episode.

Art.7: Orders / communication
o For misunderstanding, delays or improper transmission of order data and messages resulting from the use of Internet or other means of communication between buyer and Tessa Koops, or between Tessa Koops and others, as it relates to the relationship between buyer and Tessa Koops, Tessa Koops is not liable.

Art.8: Personal
o Tessa Koops respects the privacy of all users of its site and adheres to the Data Protection Act Registration. The personal information provided buyer Tessa Koops, will always be treated with care and confidentiality.
o The personal information includes all data entered into the order form.
o Tessa Koops will use your personal information to fulfill the contract. The data is not made available to third parties unless they directly relate to the contract agreed between buyer and Tessa Koops.
o Buyer can always see the personal data by writing (via letter or email) request to this effect to be sent to Tessa Koops. Within 4 weeks will be provided an overview of the existing personal data. If the buyer correction, addition or deletion wishes, buyer must report in writing. Tessa Koops will in all cases immediately follow your instructions, or delete your information from our database.

Art.9: Miscellaneous
o If the buyer writes to Tessa Koops an address, Tessa Koops entitled to that address to send all orders unless buyer writes Tessa Koops details of another address to which your orders are to be sent.
o If by Tessa Koops for any length of time does not deviate from these Conditions, will not prejudice their right to demand immediate and strict compliance with these conditions. Buyer can never assert any right by virtue of the fact that Tessa Koops applying accommodating these Terms.
o If one or more provisions of these Terms or any other agreement with Tessa Koops in conflict with any applicable legal provision, the provision will lapse and will be replaced by adopting a by Tessa Koops new law lawful condition.
o Tessa Koops is competent in the execution of your order(s) using third parties.

Article 10. Applicable law and competent court
o All rights, obligations, offers, orders and agreements to which these Conditions apply, including these conditions, only Dutch law.
o All disputes between parties will be submitted exclusively to the competent court in the Netherlands.
